Terms and Conditions of Use

1. IDENTIFICATION

ECO Impact Tech, S.L. (hereinafter “DEVERA” or “we”), with registered address at Calle de la Travesía, S/N, Edificio La Terminal, ZIP Code 46024 Valencia (Spain), Tax ID (NIF) B56263155, registered in the Commercial Registry of Valencia, Volume 11426, Book 8704, Folio 194, Section 8, Page V212765, Entry 1, is the owner of the website www.devera.ai and the platform accessible at app.devera.ai (hereinafter, the “Platform” or “Tool”).

2. PURPOSE

2.1. These Terms and Conditions (hereinafter, “T&C”) govern access to, navigation in, and use of the DEVERA Platform.

2.2. The primary purpose of the Platform is the automated calculation of Product Carbon Footprint (PCF) in accordance with the ISO standard, using Life Cycle Assessment (LCA) methodology and internationally recognized databases.

2.3. The User obtains a non-exclusive, limited, revocable, non-transferable, and non-sublicensable license to use the Platform while their account remains active and they have available credits.

3. DEFINITIONS

• User: Any individual or legal entity that accesses and uses the Platform.
• Account: The User’s personal registration on the Platform.
• Credits: Consumption units that enable Product Carbon Footprint analyses on the Platform.
• PCF Analysis: Calculation of a product’s Carbon Footprint under Cradle-to-Grave or Cradle-to-Gate, following the 3–6 lifecycle phases (raw materials, packaging, manufacturing, transport, use, and end-of-life).
• Report: Document generated by the Platform containing the PCF analysis results.
• User Data: Any information, documents, files, or data uploaded or entered by the User into the Platform, as well as Reports generated from such data.

4. ACCOUNT REGISTRATION

4.1. To use the Platform, the User must create an account by providing truthful, complete, and up-to-date information.

4.2. The User is responsible for:

• Maintaining the confidentiality of their access credentials.
• All activities carried out from their account.
• Immediately notifying DEVERA of any unauthorized use of their account.

4.3. DEVERA reserves the right to suspend or cancel accounts that violate these T&C.

5. CREDIT SYSTEM

5.1. Operation

5.1.1. The Platform operates through a prepaid credit system. Each PCF analysis consumes a specific number of credits based on the complexity of the product analyzed.

5.1.2. Credits can be purchased through the Platform via the packages available at any given time.

5.2. Credit Characteristics

5.2.1. Credits do not expire and remain valid as long as the User’s account is active.

5.2.2. Credits are non-refundable once purchased. By making a purchase, the User expressly accepts this condition.

5.2.3. Credits are non-transferable and cannot be assigned, sold, or transferred to third parties or other accounts.

5.2.4. In case of account closure, unused credits will be forfeited without right to compensation.

5.3. Pricing and Payment

5.3.1. Credit package prices are displayed in Euros (€) and include applicable VAT, unless otherwise indicated.

5.3.2. Accepted payment methods include credit and debit cards (Visa, MasterCard, American Express), processed through secure payment gateways. DEVERA does not store sensitive card data.

5.3.3. DEVERA reserves the right to modify credit package prices at any time. Changes will not affect credits already purchased.

5.4. Promotional Codes

5.4.1. DEVERA may offer promotional codes granting additional credits or discounts. These codes will be subject to their own terms of use and validity.

5.5. API Access

5.5.1. Users may access the Platform’s functionality programmatically through the API, subject to the same credit consumption as web usage.

5.5.2. API keys are personal and non-transferable. The User is responsible for maintaining the confidentiality of their API keys.

5.5.3. DEVERA reserves the right to impose rate limits on API usage to ensure platform stability.

5.5.4. Abuse of the API (excessive requests, scraping, or attempts to circumvent rate limits) may result in immediate suspension of API access.

5.6. Trial Analysis

5.6.1. Unregistered users may perform one (1) complimentary PCF analysis to evaluate the Platform’s capabilities. Trial analysis can be blocked at any time.

5.6.2. This trial is limited to one analysis per user/device and is subject to the same terms regarding data and results as paid analyses.

5.6.3. To access additional analyses, users must register and purchase credits.

5.6.4. Each individual or entity is entitled to a single complimentary trial analysis. Creating multiple accounts, using different email addresses, devices, or any other means to obtain additional free trial analyses is strictly prohibited and constitutes fraudulent use under Section 9.2 of these T&C. DEVERA reserves the right to employ technical measures (including but not limited to IP tracking, device fingerprinting, and behavioral analysis) to detect and prevent such abuse.

6. PCF ANALYSIS SERVICE

6.1. Service Description

6.1.1. The Platform enables Product Carbon Footprint calculation following the ISO 14040/44/67 methodology, structured in 6 phases:

• Raw Materials: Extraction and processing of materials.
• Packaging: Packaging materials and production.
• Manufacturing: Manufacturing and assembly processes.
• Transport: Logistics and distribution.
• Use: Product usage phase.
• End-of-Life: Waste management and recycling.

6.1.2. Calculations are based on internationally recognized emission factor databases, including Ecoinvent and other scientific sources.

6.2. Informational Nature

6.2.1. Results provided by the Platform are for informational and guidance purposes only. They do not constitute certification, warranty, or regulatory approval of any kind.

6.2.2. Analyses are estimates based on data entered by the User and available databases, which may contain approximations inherent to any LCA methodology.

6.3. User Responsibility for Data

6.3.1. The reliability and accuracy of results depends directly on the quality and truthfulness of data provided by the User.

6.3.2. DEVERA shall not be liable for inaccuracies arising from incomplete, erroneous, or outdated data entered by the User.

6.4. Reports Modification

6.4.1. Users may request modifications to existing Reports through the Platform’s chat interface. Each modification request that results in a new version consumes three (3) credits and one (1) credit for Emission Factors refinement.

6.4.2. The Platform maintains a version history of Reports. Users may revert to previous versions at any time.

7. DATA SECURITY AND CONFIDENTIALITY

7.1. Protection of User Data

7.1.1. DEVERA understands that Users may upload sensitive business information, including product formulations, supplier data, manufacturing processes, and other proprietary information.

7.1.2. We are committed to protecting the confidentiality, integrity, and security of all User Data uploaded to the Platform.

7.2. Security Measures

7.2.1. DEVERA implements appropriate technical and organizational measures to protect User Data, including:

• Encryption in transit: All data transmitted between the User and the Platform is encrypted using TLS/SSL protocols.
• Encryption at rest: User Data stored on our servers is encrypted using AWS EBS encryption with AES-256.
• Access controls: Strict access controls limit who can access User Data within our organization.
• Secure infrastructure: The Platform is hosted on EU-based servers (AWS European Union) with restricted access, automated backups, and network isolation between services.

7.3. Data Usage and Confidentiality

7.3.1. We will not sell, share, or disclose User Data to third parties for commercial purposes.

7.3.2. User Data will only be accessed by DEVERA personnel when strictly necessary for: providing the contracted service; technical support at the User’s request; complying with legal obligations.

7.3.3. DEVERA may use anonymized and aggregated data (that cannot identify individual Users or their products) to: improve the Platform’s methodology and accuracy; generate industry benchmarks and statistics; conduct internal research and development.

7.4. Data Retention

7.4.1. User Data, including uploaded documents and generated reports, will be retained for the duration of the User’s active account.

7.4.2. Upon account deletion, User Data will be permanently deleted within 30 days, except where retention is required by law.

7.4.3. Users may request deletion of specific data or reports at any time by contacting info@devera.ai.

7.5. Third-Party Services

7.5.1. The Platform may use third-party services (such as cloud hosting providers and AI services) to deliver its functionality. These providers are contractually bound to maintain confidentiality and security standards equivalent to our own.

7.5.2. When AI-powered features are used, data is processed by Anthropic (Claude) in accordance with our Data Processing Agreement, which prohibits the use of User Data for AI model training. Product data is processed solely to generate your report and is not retained by Anthropic beyond the analysis session.

7.5.3. Personal information (email, credentials, billing details) is never transmitted to AI service providers. Only product-related data necessary for the carbon footprint analysis is processed.

7.5.4. In order to provide AI-powered analysis features, product-related data is transferred to servers located in the United States operated by Anthropic, PBC. This transfer is conducted in compliance with applicable data protection regulations, including the implementation of appropriate safeguards such as Standard Contractual Clauses (SCCs) approved by the European Commission. Similarly, payment processing through Stripe involves data transfers to the United States under equivalent safeguards.

8. INTELLECTUAL PROPERTY

8.1. DEVERA is the owner or valid licensee of all intellectual and industrial property rights related to the Platform, including source code, methodology, trademarks, logos, designs, texts, images, and interfaces.

8.2. Access to and use of the Platform does not grant the User any right to modify, reproduce, publicly communicate, distribute, or transform any element of the Platform without DEVERA’s prior, express, written consent.

8.3. The following are expressly prohibited:

• Removing or altering copyright notices, watermarks, or other protective measures.
• Decompiling, reverse engineering, or extracting the Platform’s source code.
• Using the DEVERA brand or distinctive elements without authorization.

8.4. User Data: The User retains ownership of the data they enter into the Platform. By using it, they grant DEVERA a license to process such data for the purpose of providing the contracted service.

8.5. Ownership of Reports and Results

8.5.1. Reports generated by the Platform are owned by the User who commissioned the analysis. The User has full rights to use, publish, share, and distribute the PCF results contained in their Reports.

8.5.2. This ownership applies regardless of whether the analyzed product is manufactured, sold, or owned by the User. Users may analyze products from third parties (e.g., suppliers, clients, competitors) and retain full rights to the resulting Reports.

8.5.3. The User may use the Reports for any lawful purpose, including but not limited to: internal decision-making and sustainability assessments; client deliverables (for consultants and service providers); supplier evaluation and procurement processes; public communication and marketing (subject to Section 9.2); regulatory compliance and reporting.

8.5.4. DEVERA retains no ownership rights over the specific PCF values, calculations, or conclusions contained in User Reports.

9. RULES OF USE

9.1. The User agrees to use the Platform lawfully and in accordance with these T&C.

9.2. The following are expressly prohibited:

• Using the Platform for illegal or unauthorized purposes.
• Introducing viruses, malware, or malicious code.
• Attempting to access restricted areas, servers, or networks without authorization.
• Breaching security or authentication measures.
• Overloading infrastructure or taking actions that disrupt normal operation.
• Collecting data from other users without authorization.
• Using results to make misleading public claims.
• Using results to make misleading environmental claims or engage in “greenwashing”. Users are responsible for ensuring any public communication of PCF results is accurate, contextualized, and compliant with applicable advertising and environmental claims regulations.
• Presenting estimates as certified or audited values without appropriate disclaimers.
• Creating multiple accounts or using fraudulent means to circumvent usage limits, including but not limited to obtaining multiple free trial analyses.

9.3. Violation of these rules may result in immediate suspension or cancellation of the account, without right to credit refund.

10. LIMITATION OF LIABILITY

10.1. DEVERA has adopted all reasonable measures to ensure the security and proper functioning of the Platform.

10.2. However, DEVERA does not guarantee: continuous and uninterrupted availability of the Platform; complete absence of technical errors; that results will be exhaustive or suitable for all specific use cases.

10.3. To the maximum extent permitted by law, DEVERA shall not be liable for: damages arising from incomplete or inaccurate data provided by the User; direct or indirect damages arising from the use or inability to use the Platform; loss of profits, reputational damage, or other consequential losses; unauthorized access due to causes beyond DEVERA’s control; business or strategic decisions based on analysis results.

11. RIGHT OF WITHDRAWAL

11.1. In accordance with Article 103 of Royal Legislative Decree 1/2007, the right of withdrawal does not apply to digital content not supplied on a tangible medium when performance has begun with the consumer’s prior express consent.

11.2. By purchasing credits, the User expressly consents to contract performance beginning immediately, waiving their right of withdrawal once credits are available in their account.

12. MODIFICATIONS

12.1. DEVERA reserves the right to modify these T&C at any time.

12.2. Substantial modifications will be notified with a minimum of 15 days’ advance notice via the email address associated with the User’s account.

12.3. Continued use of the Platform after modifications take effect implies acceptance of the new T&C.

12.4. If the User disagrees with the modifications, they may cease using the Platform before they take effect.

13. DATA PROTECTION

13.1. Personal data processing will be carried out in accordance with applicable regulations and our Privacy Policy.

13.2. DEVERA may analyze anonymized or aggregated data to improve its methodology and services, without revealing confidential User information.

13.3. The User is responsible for having an adequate legal basis to provide any personal data to DEVERA.

14. SUSPENSION AND TERMINATION

14.1. DEVERA reserves the right to suspend or terminate User access to the Platform in case of: violation of these T&C; fraudulent or abusive use; legal or security requirements.

14.2. The User may cancel their account at any time through their profile settings or by contacting info@devera.ai.

14.3. Upon cancellation, unused credits will be forfeited without right to refund.

15. GENERAL PROVISIONS

15.1. Severability: If any provision of these T&C is declared null, the remaining provisions shall maintain their full validity.

15.2. No Waiver: Failure by DEVERA to exercise any right shall not constitute a waiver thereof.

15.3. Assignment: The User may not assign their rights or obligations under these T&C without DEVERA’s prior consent.

15.4. Entirety: These T&C, together with the Privacy Policy, constitute the complete agreement between the parties regarding use of the Platform.

16. APPLICABLE LAW AND JURISDICTION

16.1. These T&C are governed by Spanish law.

16.2. For the resolution of any dispute, both parties expressly submit to the Courts and Tribunals of the city of Valencia (Spain), waiving any other jurisdiction to which they might be entitled.

17. ACCEPTANCE

Access to and use of the Platform implies full and unconditional acceptance of these Terms and Conditions. If you do not agree with them, please refrain from using the Platform.
